My 2-year fixed-term contract is ending — can my landlord force me out now that fixed-term contracts are banned?

The 2024 ban on fixed-term tenancies was not retroactive, which leaves a large group holding older two-year contracts and no clear sense of whether the new rules help them at all. The transition arrangements are where the answer sits, and they are easy to misread in either direction.

Your existing contract is grandfathered, so the ban doesn't rescue you here. Contracts signed before 1 July 2024 keep their original end date and still terminate automatically then — but only if your landlord follows the notice procedure, meaning they wrote to you between one and three months before the end date telling you it's ending. Skip that step, and the contract actually converts to indefinite by law, so check your inbox and post carefully before assuming you have to leave. New contracts signed since 1 July 2024 default to indefinite/permanent; fixed terms only survive for a narrow list of exceptions — students, urgentie cases, target-group housing, Leegstandswet lets, hospitaverhuur, and the diplomatenclausule — and even those are capped at two years.
